Getting into a car accident with a 16-year-old uninsured driver?

I live in San Diego, California. I recently got into a car accident with a 16-year-old uninsured driver, who was using his mother's car at the time and had two underaged passengers. I was in a business area (25 MPH) and I was switching lanes into the right lane. I had my right hand blinker on and was in the process of switching lanes. The 16-year-old driver was speeding and quickly hit my front right end. I had a witness - who reported two things - with the police, he reported that the 16-year-old tried to avoid me by getting into the bike lane, but then reported with my insurance company that the 16-year-old ran straight into my car at 50 MPH. They are currently finding me 80% at fault because of the police report. The police report was obviously misrepresented. What steps can I take to fix this?

I live in New York. I'm 22. I was on my college insurance plan, but I lost it when I went on medical leave. I had an extension plan, but that also expired. I have no job because I'm too sick to work. On 7/24 I was at a Dairy Queen drive thru the person behind me hit the truck I was driving. I was looking at her in the rear view mirror the entire time. She had a cigarette hanging from her mouth that was unlit and she eventually backed up after hitting me. I got out of the truck and looked and I did not see any damage. She then said I didn't move you hit me I then told her No I did not hit you I am in front of you and this truck was never in reverse. Since there was no damage to the truck I did not bother getting any of her information since it was not my fault. On 7/27 I got a call from the police saying she told them I hit her. I gave them my side of the story and they said she had a witness who was a passenger in her car and they will be in touch. I also let them know I had a witness as well. The cop called me back yesterday and wanted to get my insurance information so her and I could exchange information. My question is do I have to give my insurance information to this cop? I did not hit this woman and I think she is trying to get one over on the insurance company. The cop said yesterday I'm surprised the truck does not have any damage because her car does have damage. This truck was a rental truck which was inspected at the time it was dropped back off at the rental company obviously there was no damage to it. This woman looked like she was on something to begin with and I'm guessing she was not paying attention probably looking for a lighter and let off the break and hit me. Which I still don't see how her car would be so damaged. I don't want this con artist having my information. So should I tell the cop I am not giving him my insurance information and tell her to take it to court? Should I get a lawyer? How much would it cost to insure a large SUV for a 16 year old?

I have always wanted this car: http://pictures.topspeed.com/IMG/crop/200608/2006-toyota-sequoia-1_460x0w.jpg The Toyota Sequoia. I know it gets crappy gas mileage, but ive seen worse. And plus Im not gonna be driving that much either. my school is very close to me, along with all my friends houses. But how much will insurance be at your best guess? Also, if I don't blow off gas, and waster it, how much money do you think I will pay per month in California? Dont try to tell me that I am not old enough to be behind an SUV, because 1) Im going to be learning how to drive from my parents in an suv, so i will have some experience 2) my parents want me to get an SUV 3) Im not a dumb a** whos gonna go 50 mph and try to cut a corner and flip over. Bottom line is, im getting an suv and thats that.
